1) Acceptance of Terms

By creating an account, using watchlists, placing a bid, or purchasing an item on bigevents.com.my (the “Site”), you agree to these Terms. We may update them at any time by posting a new version. Your continued use constitutes acceptance.

2) Eligibility & Accounts

  • You must be 18 years or older and able to form a binding contract.
  • You may maintain one account and must provide accurate information.
  • You are responsible for account security and any activity under your login.

3) Listings, Descriptions & Condition

  • Lots are described in good faith. Unless expressly stated otherwise, items are sold as-is, as available, without warranties (merchantability/fitness), and may show signs of prior handling or storage.
  • We may correct obvious errors or withdraw any lot at any time before sale completes.

4) Bidding Rules

  • Bids are binding when placed. No bid retractions except where required by law.
  • Each lot may carry a reserve price and a minimum increment.
  • If enabled, an anti-sniping window may automatically extend the auction end when a valid bid arrives shortly before close.
  • Server time shown by the platform is authoritative.
  • Tie-breaking: Higher amount wins; if the same amount, the earlier timestamp wins.
  • Shill bidding, collusion, or other manipulation is prohibited and may result in ban and legal action.

5) Notifications

Operational emails (e.g., watchlist “live/ended,” outbid notices, winner invoices) are part of the service. Delivery is not guaranteed; you must monitor the lot page for the current status.

6) Determining the Winner

  • At the close of the auction (including any anti-sniping extension), the eligible highest bid above any reserve is the provisional winning bid.
  • We may request identity/payment verification before confirming a sale.
  • We may cancel a winning bid if: fraud is suspected, payment fails, the bidder violates these Terms, the lot description contained a material error, or the item becomes unavailable.

7) Pricing, Taxes & Fees

  • All amounts are in Malaysian Ringgit (MYR).
  • Buyer’s Premium: [NONE / __%] (select one; default None unless you set it).
  • Prices are exclusive of any taxes, duties, shipping, insurance, or customs charges unless stated. You are responsible for all applicable amounts.

8) Payment & Invoicing

  • Payment deadline: within 48 hours of the winner notification unless stated otherwise.
  • Accepted methods: the payment methods offered at checkout (e.g., major cards).
  • We may cancel the order for non-payment and offer the lot to the next highest bidder or re-auction it. We may suspend/ban accounts for non-payment.

9) Shipping, Collection & Risk

We may void a transaction or correct a mistake where there is a material listing error (e.g., obvious price or description mistake), suspected fraud, or legal/regulatory issue. If you’ve already paid, our liability is limited to a refund of the price paid for that lot (excluding consequential losses).

11) No Warranty; Limitation of Liability

Except where prohibited by law, we disclaim all warranties. To the maximum extent permitted, we are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of data, profits, goodwill, or business, even if advised of the possibility. Our aggregate liability related to a lot is capped at the amount you paid for that lot.

12) Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of law or third-party rights.

13) Personal Data & Communications (PDPA)

We process personal data in accordance with the Personal Data Protection Act 2010 (Malaysia). We use your data to operate the auction (account, bidding, watchlist, notifications, checkout, anti-fraud). Marketing emails are opt-in and can be unsubscribed. See our Privacy Notice for details. You consent to receive operational emails and electronic records for transactions.

14) Intellectual Property

All Site content (logos, images, text, UI) is our or our licensors’ property. You may not copy, scrape, or exploit it except for personal participation in the auction.

15) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., network outages, platform incidents, strikes, fire, flood, act of God, war, regulation).

16) Third Parties / Sponsor Notice

Unless expressly stated, sponsors/partners (including Maybank) are not a party to the contract of sale. Any use of sponsor marks is by permission and does not make the sponsor a seller or guarantor of items.

17) Governing Law & Disputes

These Terms are governed by Malaysian law. You submit to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia. Before filing, the parties will attempt good-faith resolution within 14 days after written notice of a dispute.

18) Changes; Severability; Entire Agreement

We may update these Terms at any time; material changes will be posted on the Site with a new “Last updated” date. If a provision is invalid, the remainder stays effective. These Terms are the entire agreement regarding auctions on the Site and supersede prior communications.
